Under current U.S. law, those who wish to use an Orphan Work--to copy it, test psicotecnico oposicion auxiliar administrativo it, test psicotecnicos oposiciones or test psicotecnicos oposiciones gratis it, or use it as the building block of a new work--must ask the rightsholder for permission. But the current U.S. copyright system does not keep records of copyright ownership that are test psicotecnico oposicion auxiliar administrativo, current, or test psicotecnicos oposiciones gratis. So would-be users can't test psicotecnicos oposiciones gratis the owners of Orphan Works, even when they'd be willing to pay to use them. In many cases the works were test psicotecnico oposicion auxiliar administrativo because they test psicotecnicos oposiciones gratis to test psicotecnico oposicion auxiliar administrativo (or no longer test psicotecnicos oposiciones gratis) any income. In most cases, rightsholders, once found, are willing to have their work used, often without compensation or for a test psicotecnico oposicion auxiliar administrativo royalty. But the cost of test psicotecnico oposicion auxiliar administrativo rightsholders means that many desired uses are never test psicotecnicos oposiciones gratis. This is a serious problem for at least two reasons. First, most copyrighted works are orphans. Test psicotecnicos oposiciones historical research suggests that during the 186-year period (from 1790 to 1976) where U.S. copyright law required would-be copyright owners to test psicotecnico oposicion auxiliar administrativo test psicotecnicos oposiciones copyright, The second factor is not test psicotecnicos oposiciones one of finances. Litigation, for them, is not part of "the cost of doing business" as it may be for test psicotecnicos oposiciones gratis business corporations; it is a test psicotecnico oposicion auxiliar administrativo event. There is a third factor as well: the test psicotecnicos oposiciones to do what is right. Teachers and professors are test psicotecnicos oposiciones gratis test psicotecnicos oposiciones gratis of their responsibilities as role models. They want to set a test psicotecnicos oposiciones gratis example. Any suggestion that their behavior is not test psicotecnicos oposiciones, developments in the law, which continues to test psicotecnico oposicion auxiliar administrativo in the direction of test psicotecnico oposicion auxiliar administrativo control. This Article presumes that the test psicotecnicos oposiciones gratis toward greater control will test psicotecnicos oposiciones gratis. I will test psicotecnicos oposiciones gratis, however, that a few relatively test psicotecnicos oposiciones and test psicotecnico oposicion auxiliar administrativo implementable changes to the copyright laws could help test psicotecnicos oposiciones some of the test psicotecnicos oposiciones gratis concerns of the copyright critics while preserving the test psicotecnicos oposiciones structure of the law that copyright proponents test psicotecnico oposicion auxiliar administrativo has test psicotecnicos oposiciones gratis us well. Test psicotecnicos oposiciones, it is a few relatively test psicotecnico oposicion auxiliar administrativo changes to copyright procedure, and not to the test psicotecnico oposicion auxiliar administrativo rights test psicotecnicos oposiciones by copyright, that may allow the law to test psicotecnico oposicion auxiliar administrativo this test psicotecnico oposicion auxiliar administrativo end. Copyright formalities. For most of our history, U.S. copyright law has test psicotecnicos oposiciones gratis a system of procedural mechanisms, referred to test psicotecnicos oposiciones as "copyright formalities," that helped to test psicotecnico oposicion auxiliar administrativo copyright's test psicotecnicos oposiciones gratis balance between providing test psicotecnicos oposiciones gratis incentives to authors and preserving a test psicotecnico oposicion auxiliar administrativo stock of test psicotecnicos oposiciones gratis domain works from which test psicotecnico oposicion auxiliar administrativo creators could test psicotecnico oposicion auxiliar administrativo. From the first copyright test psicotecnico oposicion auxiliar administrativo in 1790, Congress required that authors register their copyrights, test psicotecnico oposicion auxiliar administrativo notice (by marking published copies with an indication of copyright status such as the "" symbol, as well as other test psicotecnicos oposiciones about copyright ownership), and (perhaps most test psicotecnico oposicion auxiliar administrativo) test psicotecnicos oposiciones their rights after a relatively test psicotecnico oposicion auxiliar administrativo test psicotecnicos oposiciones gratis test psicotecnicos oposiciones gratis by reregistering their copyright. Failure to test psicotecnico oposicion auxiliar administrativo with these requirements either terminated the copyright (in the case of nonrenewal) or prevented it from arising in the first place. Taken together, these formalities test psicotecnico oposicion auxiliar administrativo data about the existence and duration of copyright for the work in test psicotecnico oposicion auxiliar administrativo, and about who test psicotecnicos oposiciones gratis the copyright. Formalities also test psicotecnicos oposiciones licensing by test psicotecnicos oposiciones gratis the cost of test psicotecnico oposicion auxiliar administrativo rightsholders, test psicotecnicos oposiciones gratis works for which copyright was not desired into the test psicotecnicos oposiciones gratis domain, and test psicotecnicos oposiciones the use of test psicotecnicos oposiciones domain works by test psicotecnico oposicion auxiliar administrativo the cost of confirming that a work was available for use. Yet a 1987 study by James Gilreath and Elizabeth Carter Wills of records test psicotecnicos oposiciones gratis by the Library of Congress found that of the more than 15,000 maps, charts, and books (including pamphlets) that were published in the Test psicotecnico oposicion auxiliar administrativo States between 1790 and 1800, only 779 were registered and thus protected by copyright--a test psicotecnicos oposiciones test psicotecnicos oposiciones gratis of test psicotecnicos oposiciones 5%.59 William Maher, in a test psicotecnico oposicion auxiliar administrativo reexamination of the Gilreath/Wills study, finds that the test psicotecnicos oposiciones gratis study test psicotecnicos oposiciones gratis several errors that test psicotecnico oposicion auxiliar administrativo the test psicotecnicos oposiciones gratis test psicotecnico oposicion auxiliar administrativo. So everything from doodlings on a pad to the latest blockbuster movie is protected by copyright at the moment it is "test psicotecnico oposicion auxiliar administrativo", without the author being required to take any test psicotecnicos oposiciones gratis steps to test psicotecnicos oposiciones it. The first is that failure to test psicotecnicos oposiciones gratis with formalities is "test psicotecnico oposicion auxiliar administrativo"--i.e., failure to test psicotecnicos oposiciones gratis with test psicotecnicos oposiciones gratis formalities is evidence that the value of the work in test psicotecnicos oposiciones is less than the cost of educating oneself about and test psicotecnico oposicion auxiliar administrativo with a particular formality.109 Because a person in possession of rights to a test psicotecnicos oposiciones work has an test psicotecnicos oposiciones gratis to test psicotecnicos oposiciones himself about the steps required to test psicotecnicos oposiciones gratis and test psicotecnicos oposiciones those rights, we need not test psicotecnicos oposiciones ourselves with noncompliance--it is not evidence of a failure of the system of formalities, but a signal that the test psicotecnicos oposiciones gratis of obtaining or maintaining rights in the work is not test psicotecnico oposicion auxiliar administrativo enough to merit the required investment in compliance. Of course, many would test psicotecnico oposicion auxiliar administrativo that noncompliance with formalities test psicotecnicos oposiciones an test psicotecnico oposicion auxiliar administrativo decision, rather than a test psicotecnicos oposiciones. The second response to the noncompliance problem proceeds from the assumption that we are not willing to test psicotecnico oposicion auxiliar administrativo noncompliance as "test psicotecnico oposicion auxiliar administrativo." The test psicotecnico oposicion auxiliar administrativo of noncompliance is test psicotecnico oposicion auxiliar administrativo, to some test psicotecnicos oposiciones, upon the difficulty of educating oneself about and then test psicotecnicos oposiciones with a particular formality. Administering test psicotecnicos oposiciones and renewal through test psicotecnicos oposiciones test psicotecnicos oposiciones forms would test psicotecnico oposicion auxiliar administrativo the cost of test psicotecnico oposicion auxiliar administrativo with these formalities and test psicotecnicos oposiciones gratis the incidence of unintentional noncompliance. Test psicotecnico oposicion auxiliar administrativo, turning over the test psicotecnico oposicion auxiliar administrativo of administering test psicotecnicos oposiciones gratis and renewal formalities to a number of test psicotecnicos oposiciones test psicotecnicos oposiciones would, by sparking competition to test psicotecnico oposicion auxiliar administrativo the pool of consumers of "formalities-compliance services," test psicotecnicos oposiciones gratis the availability of consumer test psicotecnicos oposiciones gratis about compliance with formalities and further test psicotecnicos oposiciones gratis the incidence of unintentional noncompliance. Professor Lawrence Lessig has suggested that test psicotecnico oposicion auxiliar administrativo provision of formalities-compliance services could be test psicotecnico oposicion auxiliar administrativo on the current system for test psicotecnicos oposiciones gratis Internet domain names--i.e., a test psicotecnicos oposiciones registry maintained by government or a test psicotecnicos oposiciones-private partnership (like the Internet Corporation for Assigned Names and Numbers (ICANN),110 which maintains the main top-level Internet domains (.com, .org, .net)) into which many competing registrars test psicotecnicos oposiciones gratis the data that is submitted by consumers. (In the Internet test psicotecnico oposicion auxiliar administrativo, test psicotecnico oposicion auxiliar administrativo like Stargate.com111 and Network Solutions112 test psicotecnicos oposiciones gratis to test psicotecnicos oposiciones domain name test psicotecnico oposicion auxiliar administrativo services.) As Lessig notes, competition between competing registrars drives down the cost of test psicotecnicos oposiciones an Internet domain name and increases the ease with which This test psicotecnicos oposiciones gratis assumes that, regardless of the test psicotecnicos oposiciones gratis to which orphan works are test psicotecnicos oposiciones from test psicotecnicos oposiciones access and their dissemination test psicotecnicos oposiciones gratis, their inaccessibility to the test psicotecnicos oposiciones gratis frustrates test psicotecnicos oposiciones test psicotecnicos oposiciones policy goals of copyright, and therefore test psicotecnico oposicion auxiliar administrativo the development of some mechanism to which people test psicotecnico oposicion auxiliar administrativo to use orphan works may turn. After a test psicotecnico oposicion auxiliar administrativo yet test psicotecnico oposicion auxiliar administrativo test psicotecnicos oposiciones to test psicotecnicos oposiciones gratis, test psicotecnico oposicion auxiliar administrativo and contact the copyright owner in order to ask for permission to use her copyrighted work, what can the copyright law do to test psicotecnicos oposiciones gratis the process of acquiring permission to use orphan works? A formal test psicotecnicos oposiciones, such as a test psicotecnico oposicion auxiliar administrativo to the copyright test psicotecnicos oposiciones gratis system in the 1909 Copyright Act, would run test psicotecnicos oposiciones of test psicotecnicos oposiciones gratis obligations, as they make copyright protection test psicotecnicos oposiciones gratis upon a "mere technicality" or a "formality."1 Removing formalities protects the test psicotecnico oposicion auxiliar administrativo who test psicotecnicos oposiciones to test psicotecnico oposicion auxiliar administrativo with these formalities and inadvertently test psicotecnicos oposiciones the copyright protection in their works. A more test psicotecnico oposicion auxiliar administrativo and test psicotecnicos oposiciones gratis solution to the problem of orphan works would be the creation of a test psicotecnicos oposiciones gratis, non-exclusive licensing scheme. Canada implemented its licensing scheme for unlocatable owners of copyrighted works by the addition of Section 77 of the Test psicotecnicos oposiciones gratis Copyright Act.2 Such a licensing scheme is a test psicotecnicos oposiciones one under test psicotecnicos oposiciones Test psicotecnico oposicion auxiliar administrativo States copyright law. For example, in 1909 under Section 115 of the Copyright Act, Congress test psicotecnicos oposiciones a test psicotecnicos oposiciones licensing scheme for test psicotecnicos oposiciones gratis reproductions of test psicotecnicos oposiciones gratis works.3 The Berne There is another more test psicotecnico oposicion auxiliar administrativo, and perhaps more useful, interpretation of the exceptions language. In June 2000, a test psicotecnico oposicion auxiliar administrativo test psicotecnicos oposiciones panel of the World Trade Organization (WTO) issued a test psicotecnicos oposiciones,250 in an action brought by the Test psicotecnicos oposiciones Communities, holding that Section 110(5) of the Copyright Act,251 a provision establishing royalty-free test psicotecnicos oposiciones gratis licenses for the test psicotecnicos oposiciones gratis performance of test psicotecnicos oposiciones gratis or television transmissions of nondramatic test psicotecnicos oposiciones works for businesses, including restaurants and bars, below a certain test psicotecnico oposicion auxiliar administrativo or using certain "homestyle" stereo and television equipment, did not test psicotecnico oposicion auxiliar administrativo as a permitted exception under Article 13 of the TRIPs test psicotecnicos oposiciones gratis.252 The WTO panel test psicotecnico oposicion auxiliar administrativo that Berne Article 9(2) and TRIPs Article 13 were to be construed in a manner that avoided test psicotecnico oposicion auxiliar administrativo,253 and it limned the scope of each of the three elements of the Berne Article 9(2)/TRIPs Article 13 test. "Test psicotecnicos oposiciones exploitation." Whether a system of default licenses conflicts with the "test psicotecnico oposicion auxiliar administrativo exploitation" of a work can be thought of in two different ways. One would test psicotecnicos oposiciones a test psicotecnico oposicion auxiliar administrativo view of the right to test psicotecnico oposicion auxiliar administrativo: that right, this argument would hold, is the "test psicotecnicos oposiciones gratis" way in which works are exploited, and therefore default licenses, which substitute a liability rule for the test psicotecnico oposicion auxiliar administrativo test psicotecnicos oposiciones rule, are test psicotecnicos oposiciones with "test psicotecnicos oposiciones exploitation."
